Cyngor Gwynedd Council - The Car Pool, A Party And An Internal Review.

The return of staff to council offices should by now be complete - just in time for the council elections. 28 councillors have already been elected in uncontested wards as they were the only ones to put their name forward - 19 of these are Plaid Cymru members giving them nearly 30% control of the council before a vote is even cast.

So what unresolved matters will face the new councillors?
There is still the issue of Gwynedd council's own #partygate scandal during the pandemic -

'The incident which saw them share a minibus was described by Dilwyn Williams, chief executive of Gwynedd Council  as "completely unacceptable" in a letter to staff.
Mr Williams said in the letter that "the individuals involved will be dealt with accordingly" as the council has had to fork out additional costs to cover their work during the self isolation period.'

Then there was the issue of officers misuse of the council's vehicles as reported in the Daily Post, last year -

“We are aware that there are some instances where staff may not have adhered to this policy, and we are working with our trade union partners to address this matter and update our policy.
“We can also confirm that the council removed a banner which was placed without consent on railings near Morrisons roundabout in Caernarfon last weekend.”

Any update for the public?

Then there is the Education department and its failure to explain why the headmaster Neil Foden reported being thrown under a bus by the council during the school meals fiasco. No explanation of the video circulated on social media of the teacher appearing to have a pupil by the neck, either.

In other news, an FOI request was raised with the council last year. The Information officer did not answer the question fully and so an Internal Review was asked for. The council has failed to carry out this review and an email asking for an update was ignored...

What possible reason could the council have to ignore its duties under the FOI Act?

One Year Of Non-Compliance - Cyngor Gwynedd Council.

It is now October - one full year of Cyngor Gwynedd council being in non compliance of the Ombudsman for Wales recommendations -

"71. The Council should (within three months) seek specialist input to develop a plan for dealing with future assessment and support requests from/for those suffering with Autism."

Nick Bennett has given the council chance after chance and even expressed to the family, his frustrations over the situation with the council - all to no avail it seems.

The council's CEO, Dilwyn Williams, appears to blame the SS departments for the 'slippage' whilst doing nothing to take control of the situation, himself. Whilst the Director of SS, who has no social work background blames the recent pandemic (that doesn't explain what happened to compliance before that time)

What to do now ? Putting in yet another complaint to the council means placing 'independent investigators' in the firing line to be bullied amd overwhelmed by senior officers and I am not prepared to do that.

Raise yet another complaint with the Ombudsman ? What is the point ? Mr Bennett is not respected by anyone in this corner of North Wales and appears powerless to hold councils to account and so it would be a waste of public resources to do so.

The complaints system in Wales is not fit for purpose and Judicial Review appears to be the only way to hold any public organisation to account. But there is no legal aid and what family can afford the £25K+ - minimum - that is required to bring such a case ? Local authorities as we know have an unlimited amount of money at their disposal from public funds. 

The Ombudsman wrote to say that the autism specialist commissioned by the council promised to present their draft report to the council by the end of September 2020.

Not quite what the the recommendation called for, but, as Mr Bennett says, it is up to him to accept any variation on recommendations - as he sees fit.

No mention is made of the Ombudsman even receiving a copy of the draft report himself and even so draft reports can be changed.......

What next ? An email from the ombudsman later on today ?

Something is very, very wrong within Gwynedd council.

Cyngor Gwynedd Council - Sorry Not Sorry.

The letter of apology from the Chief Executive of Cyngor Gwynedd, Dilwyn Williams, made me think of all the other Mea Culpa's we have received in the past four years.

We have not yet replied to Mr William's letter as we await confirmation that the 'recommendations' of the Ombudsman have been completed. Cyngor Gwynedd have a history of non compliance in this case, with 'recommendations' made by independent investigators and even those of the Ombudsman for Wales.

Gwynedd Council agreed to implement the Ombudsman's latest 'recommendations' within three months. Those three months are now up.

The CEO apologised for the failing to update a child's CIN plan - surely the responsibility for the Director of Gwynedd Social Services, Morwena Edwards. But the apology from the CEO may be more sincere considering it took Mrs Edwards 5 months to officially respond to our Stage 2 complaint - badly. The Ombudsman for Wales 2019 Report calls her decision to then reverse her thinking after the publication of the Ombudsman's 2018 Report 'illogical'.

There has also been an apology from Head of Children and Families, Marian Parry Hughes.

Once again, the sincerity of this apology is in question as Mrs Hughes was the most senior manager at the meeting with the Independent Investigator who reported she felt 'overwhelmed' and 'bullied' after completing her investigation.

This Tribunal makes mention of Sharron Williams Carter -  who was also in attendance at the meeting with the Independent Investigator of our Stage 2 complaint.

Sharron Williams Carter was also the senior officer tasked with carrying out the 'recommendations' from the Independent Investigation way back in 2010 that was highly critical of senior management. The 'recommendations' were not implemented.

Mr Panther was the manager of the disabled social worker who took Gwynedd  Council to the Employment Tribunal.

We have also received an apology from Senior Operational Manager, Aled Gibbard.

Mr Gibbard was also present at the meeting in which the Investigator felt 'overwhelmed' and 'bullied'.

Delyth Davies - whose inadequate assessment of a child's needs was the main issue of the Stage 2 complaint was also present at this meeting.

Now the Ombudsman for Wales was given evidence that a social worker had lied to Investigators during the investigation and that the authors of the Directors response letter were aware of this deception.

A draft response letter that had Director, Morwena Edwards, asking the two authors - "What if the Ombudsman sees this..."

Marian Parry Hughes has just authored and presented to Council the Complaints Handling Report. Her Report makes nothing of her Department's annus horribilis. For her it is like nothing happened at all. Not even a nod in the direction of the Ombudsman who refers to the number of inaccurate references to legislation that she as Head of the Children and Families Department had made.

It is the same with the Director's of Social Services Annual Report 2019 - 'move along - nothing to see here'.
So how are County Councillors informed of the systemic failings found within Gwynedd Children and Families Department and their mishandling of complaints, year upon year ?

We have informed various committee members...and they choose to remain silent and do nothing.

What of Dilwyn Morgan, Cabinet member responsible for the Children and Families Department ? He has still not responded to us after being sent a copy of the Ombudsman's Report in June.
 
Something is so very wrong within Gwynedd council.

Cyngor Gwynedd Council CEO Apologises For Children's Services.

In June 2019, we received a letter of apology from Dilwyn O Williams, Chief Executive of Cyngor Gwynedd Council.

Mr Williams confirms the department has accepted the recommendations as stated in the Ombudsman's 2019 report.

He then apologises to us all as "a family on behalf of Gwynedd council for all the failings that have been noted within the Ombudsman's report". 

He goes on to apologise on behalf of the Children's department for the delay in providing a response to our complaint.

Mr Williams then apologises on behalf of a senior manager. He writes that the officer has asked for "his sincerest apologies to be passed to us as a family and his reassurance that this was not his intention to offend you as a family".

The Chief Executive adds - "Furthermore, I would also like to apologise for the failure to review *the* Child In Need plan" and ends asking for acceptance of "this sincere apology."


The letter is short and gives no detail of the failings of the children's department and its complaints department. Nor does it mention the behaviour of the senior managers in their treatment of the Independent Investigator in order to whitewash and sanitise the final, final Report.

Now a month later the CEO was in attendance at the Cabinet meeting of the 23rd July, 2019.
This meeting was to receive the Children and Family's Annual Complaints Handling Report, authored by Marian Parry Hughes. Mrs Hughes report contains anoma lies just like the last report (and the one before that and the one before that) but that is for another post.

The Cabinet member with responsibility for the Children's SS department, Dilwyn Morgan, had been sent a copy of the Ombudsman's report for his attention and consideration in June but at the time of writing has not replied. Nor did he attend this meeting where he should have presented the Report.

The Chief Executive made no mention of his letter of apology to the meeting nor did he reference the Ombudsman's report. He did make reference to the Ombudsman on a couple of occasions but not in regard to the report.

So We Emailed Cyngor #Gwynedd Council's Corporate Management Officers....

With Gwynedd council customer care (!) still refusing to respond to our questions regarding the Stage 2 complaint first raised with them on May 25th, last year, we emailed the Corporate Management Team, yesterday, with our concerns - Chief Executive, Dilwyn Williams, Corporate Directors, Iwan T Jones and Morwena Edwards.

As you will be aware we have a current Stage 2 complaint ongoing with Gwynedd Council Children and Families Department, first raised on the 25th of May 2017.

The Independent Investigator presented her completed report to the Council at the end of October.

We were then informed that the Council were seeking clarity from the Investigator and questioning the report.

The Council have been in possession of the completed Independent Investigators report for 11 weeks now.

The whole Stage 2 process is as you know to be completed within 25 days, do you find this acceptable ?

We have found the Counci's handling of this complaint and us as complainants to be obstructive, unhelpful and the Council to be utterly lacking in transparency and it is also obvious that Customer Care do not act independently of the Department as they should, which, we contend, leads to complainants being treated unfairly.

We have asked for information regarding the outcome of the Independent Investigation and also the Council's Complaints procedure.

No answers were given, or information provided.

We asked who within the Council we could contact to discuss our issues, we received no answer to this and worse were wrongly advised by Customer Care that we were free to discuss our complaint with the Ombudsman at any time.

We did indeed contact the Ombudsman to discuss the issues surrounding our complaint and were told -

"In relation to your dissatisfaction with the Council’s handling of your Stage 2 investigation, as I explained in my previous email, this matter does not fall within the scope of my investigation and therefore I am unable to consider it....
...If you wish for this matter to be considered by the Ombudsman, you would need to submit a complaint, by completing the online form on our website.  I am unable to speculate whether submitting a complaint to this office would affect the Council’s current Stage 2 investigation"

In light of the ongoing situation and the bad advice from Customer Care, perhaps you would be so kind as to furnish us with the information we require -

1. Were the six points of complaint upheld by the Independent Investigator or not ?

2. What were the questions presented, by the department, to the Independent Investigator regarding the report submitted to the Council in October ?

3. Who is the Adjudicating Officer in this matter?

4. On what date can we expect the Council to provide us with the report ?

5.Please provide us with a link to Gwynedd Council's Policy and Welsh Government guidelines that supports the Council in withholding the outcome of the Independent Investigator's Report and the Report itself.

6. Please advise us of our rights as complainants in relation to our being supplied with the above information, without delay.

7. We ask that if we were to raise a formal complaint into how the Council and the Customer Care department have been dealing with our formal complaint would this, in any way, interfere with or cause any further delay to our formal complaint first raised with the Council on the 25th May, 2017 ?

We also ask that you view the emails between ourselves and Customer Care, as that will give you further insight into our very pertinent concerns.

Today, we received an email from a Senior Executive Officer on behalf of Morwena Edwards.
It was brief - 3 sentences - thanking me for our email and included the line -

"I can assure you that Gwynedd Council takes all complaints seriously and I will endeavour to respond to the specific questions detailed in your email within 5 working days."

Well.. we are not assured - who would be after being treated so badly for so long ? - and so emailed back with the question we have been asking ever since the Independent report was received by The Council in October, last year.

"Have our 6 points of complaint been upheld by the Independent Investigator ?"

The email was swiftly answered by the council -

"Whilst I understand your frustrations, without having had the opportunity to look into the matter, I am unable today, to answer your question. I will respond to you within 5 working days."

More delay in a process that has taken nearly 8 months now.
