'Technical Difficulties...' Cyngor Gwynedd Council.

Two years have passed since Cyngor Gwynedd council agreed to implement the recommendations of an Ombudsman for Wales investigation yet the council remain in non compliance...

The last CEO of the council had told councillors that all recommendations had been met 'bar a nuance' - this was not correct.

The present CEO was meant to have had a meeting with the Ombudsman in which he was to provide the Ombudsman with an update and discuss issues around compliance. Unfortunately.... 'technical difficulties' meant the meeting had to be abandoned. Why the CEO could not update the Ombudsman by telephone or email remains unclear.

It has also been over two years since the Ombudsman for Wales sent two of his officers to North Wales to take a complaint in relation to non compliance with yet another Ombudsman's investigation.

                                     

The officer's explained they could not take this complaint as the Ombudsman's office had already signed off compliance without really understanding what was required of the council. The Ombudsman has apologised for the actions of the officer who signed it off.

The Ombudsman's investigator also refused to take a complaint against the social worker involved in the Stage 2 complaint investigation that senior managers of the council interfered with as the SW may have forgotten what happened....and may deny the charge..!!!

Instead, the Ombudsman wished to focus on the assessment undertaken by Gwynedd council in response to a recommendation from his previous investigation.

Concerns had been raised with the Ombudsman that the council would not treat the assessment fairly and we asked that an independent social worker be assigned. The request was refused and the council then tasked Sharon and Barry with conducting the assessment. It has come to light that Barry was not there for the assessment and one can only wonder why he was involved in the process.

The assessment carried out ended up an exercise in parent blaming...

Questions remain of who was actually in charge of the assessment. The assessor visited the parents to inform the assessment was complete before flying off to holiday in Florida the next day. Yet comments made after this have found their way into the file. Which manager in the SS department was responsible for the handling of this assessment ? A SAR (subject access request) was requested but Gwynedd council's information manager has heavily redacted the information to the extent it is unreadable. Sshh...

CEO Retires - What Next For Cyngor Gwynedd Council ?

The Chief Executive Officer of Cyngor Gwynedd council, Dilwyn Williams, has announced he is to retire at the end of this month.

Dilwyn O Williams was appointed CEO  in 2014, replacing Harry Thomas who had been in position since 2003.

Like Thomas, Mr Williams had worked for the council for many years, before the creation of the new unitary Gwynedd council and abolishment of the previous authority after the North Wales Child Abuse scandal and boundary changes.

The reign of Harry Thomas ended under a cloud with 'angry council workers will walk out of their jobs in protest after bosses were awarded pay rises of thousands of pounds while theirs were frozen...'

"Assets and customer care director Dilwyn Williams, education, skills and regeneration director Iwan Trefor Jones and planning and public protection director Dafydd Lewis had rises of £5,839 to £88,960.
Increases for 11 heads of service ranged from £1,042 to £5,094. For example the heads of social services and education saw their salaries rise by £3,311 from £72,200 to £75,511. The decision was taken by the council in June but staff say they weren’t told."

Dilwyn started off as a clerk for the former Caernarfon Council, then became Head of Accountancy for the new authority, then Strategic Resources Director, Corporate Director and finally CEO, where he has held the position for the last seven years.

His tenure as CEO began when the Westminster government austerity cuts really began to bite.
Some in the council have praised his work over the period, making £millions of cuts to vital services and jobs, the closing of community schools and youth clubs, the increasing Council Tax rises. Less services for even more money. This in the main under the dictates of the westminster government and the austerity measures first imposed by Cameron and Osbourne.

Under his stewardship, serious failings with the council have been highlighted in many reports, including five Ombudsman for Wales investigations. These include breaches of Human Rights, interference with the social services complaints process and so called 'independent' investigations, ignorance of Law, policy and procedures and basically council officer's behaving very badly, indeed.

There have been data breaches, censoring of personal information, misrepresenting evidence, misinformation and fabrication.

There was the case of the social worker being suspended by Gwynedd council for two and a half years until she won her Employment Tribunal. More on that here -

Then there was the Employment Tribunal which found against the council for their dismissal of two local teachers - “extraordinary”, “ill-conceived”, and “emphatically wrong”.

Then along came the pandemic and a year of death, stress and change for all.

At a national and a local level Wales did well with the first lockdown and community spirit came to the fore. Some schools remained open to take the children of 'key workers'. People and organisations all rallied round and ensured medications were received and food parcels delivered to those in need.

Cyngor Gwynedd council kept things very close to their chests. 'While the council's decision to change the rules was aimed at saving around £290,000 a year, GwE - which is funded by North Wales authorities - saw its expenditure increase between 2017 and 2019.'

'An audit also found that mileage claims were not being checked properly, leading to one instance where an 800 mile claim submitted for an 80 mile journey was processed before the mistake was found'

Then there was the issue of the council's car pool when it was reported that some officers were using the vehicles inappropriately, publicised by the very obvious banner next to Morrison's supermarket in Caernarfon, that was quickly taken down by the council.

A review of the council's social services policies for those with Autism without a learning disability has been released though not yet published. It mentions the ring fenced monies that have been allocated for such services over the years and calls for immediate actions.

Statutory annual reports from some council departments are already late, with no dates announced for completion nor opportunity to scrutinise what has been a truly tumultous period.

At the time of Dilwyn's announcement to retire the news came that a former colleague of his, Lucille Margaret Hughes, had died. Miss Hughes was once the Director of Gwynedd social services during the North Wales Child Abuse scandal and presided over the sacking of a social worker who attempted to whistleblow the care home abuses.

Miss Hughes, also worked for CAIS and had been living in the grace and favour apartments at Penhyrn Castle for many years.

Cyngor Gwynedd Council And Their Treatment Of The Disabled.

With regard to the statements made by Cyngor Gwynedd Council CEO, Dilwyn O Williams and the senior safeguarding and quality officer, Dafydd Paul, to the recent Care Scrutiny Committee,

The statements were given by the officer's in response to the 'damning' Report from the Ombudsman for Wales into the Children and Familiy Department revealed at a previous full Council meeting by a local Councillor.

Dilwyn Williams, confirmed to the Scrutiny Committee, that all recommendations had been met 'bar a nuance' and goes on to mention a 'miscommunication' with the Ombudsman - amongst other things.

This was not correct.. 

The Ombudsman has explained that his meeting with the CEO, in Cardiff, to discuss compliance - or more accurately non compliance was not normal. 

The CEO has since claimed that he and his officer's did not comply as they had misunderstood the Ombudsman's recommendations. But the Ombudsman's Recommendations are clear and simply written.  

Comments were made by Dafydd Paul in particular that the Ombudsman had 'challenged' the Council to contact the family regardless of their wishes. 

The Ombudsman for Wales is well aware of our thoughts regarding Gwynedd council SS officer's and has confirmed that neither himself nor any of his officer's told the council to contact the family - in any way !

We have asked both the CEO and Dafydd Paul for an explanation but they have not, as yet, responded. 

Gwynedd SS have failed to present another Ombudsman's Report, dated July,2018, for scrutiny. This case involved a young man with autism and mental health issues being left to rot in bed after Gwynedd Adult SS withdrew his support.

The council has not fully complied with recommendations made in this case either, though the Ombudsman appears to have signed this off as completed. The FOI - answered by the Ombudsman "in the public interest" - clearly shows that the original recommendation ensuring the council fully complies with the Law has not been completed.

Undertakes a review of its ASD procedures, specifically those for adults and children with high functioning ASD, and ensure that the requirements of the SSWA 2014, MHM 2010 and ASD SAP have been met.

All five Omudsman Reports over the last four years have shown major concerns and serious failings with how Gwynedd council officer's treat autistics and the disabled in the county.

How much has the disability discrimination and claims of bullying cost Cyngor Gwynedd taxpayers ?

Suspension on full pay from 13th January 2014 until receiving notice on 12th Dec 2016 will mean costs to the council of approx £90,000 to £100K in wages alone and how much did the Tribunal award this social worker ?

£30K ? £40K ? More ?
And all the other costs involved ?

Ombudsman For Wales 'Outraged' With Cyngor Gwynedd Council.

In Cyngor Gwynedd translated Minutes. senior officers openly admit that the Ombudsman is 'outraged' with them and the CEO, Dilwyn Williams, statement gave some detail, for example -

"That this had been an extremely difficult case, and as the Department had not experienced many cases in which the Ombudsman had decided against it, it was possible that we had not been successful in changing our operating principles to what the Ombudsman would have liked to have seen."

To my knowledge there are now FIVE Ombudsman for Wales Reports that have found against Gwynedd Council over the last four years - the most recent was published, last month, in the public interest, as a vulnerable person died.

The CEO is made aware of any Ombudsman's investigations by the Ombudsman himself and would have read the draft report(s) - all relevant departments are given the opportunity to comment and/or challenge any errors before publication.

What of all the council department's documents and Annual reports that should have alerted Councillors and the public to the systemic failings found within the council - over the years? 

All written by the same officer's responsible for the systemic failings and maladministration.

One Report from 2018 is being sat on and has still to be presented for scrutiny by Adult Social Services.

In the meeting's other news, four council reports were presented for scrutiny - not one contained good news.

It is disturbing that of the four reports presented to the Committee not one senior officer reported on a fundamental change to the Children's Derwen criteria.

Derwen is a partnership between Betsi Cadwaladr University Health Board, Gwynedd Council’s Social Services and now Anglesey Specialist Children's Services.

The Council has finally been forced to apply the defintion of disability as defined under the Equality Act, 2010 when assessing the needs of children.

The CEO's statement does reference non compliance with recommendations from previous Ombudsman's Investigations, but is poorly written and makes little sense

"As there had also been confusion regarding the wording of one of the Ombudsman’s recommendations relating to the parents' assessment, we also did not comply with another clause which we had agreed to implement"

There was no confusion regarding the wording.  The Ombudsman's wording is simple and clearly written.
