Cyngor Gwynedd Council - Another Cabinet Member Avoids Scrutiny...

Cyngor Gwynedd council held a Care Scrutiny Committee on the 1st February 2024. Once again, the english webcast is not working making a mockery of the council's claim to have a bilingual service.

Gwynedd's Housing Plan was discussed. It was meant to be presented by Craig ab Iago, the Cabinet member for Housing. The member had sent his apologies saying that he would try and attend the meeting later - this did not happen.

At the end of the meeting, the chair of the committee, Beth Lawton, expressed her disappointment with the member for failing to attend. A housing officer did try and explain the circumstances surrounding the member's absence, but the chair dismissed the officer's protestations. 

The behaviour of the chair is odd considering the care scrutiny committee have failed to hold cabinet members to account for the bad behaviour towards the county's disabled and autistics in particular -  culminating in several PSOW rulings against Gwynedd SS departments.

Cabinet members Beca Brown, Nia Jeffreys and now Craig ab Iago have all missed recent scrutiny committee meetings...

This was a long day for the committee with a briefing session held before the public meeting and then an informal meeting held behind closed doors after the webcast concluded.

Cyngor Gwynedd Council - Monitoring Officer 'Advice' Overturned.

 Cyngor Gwynedd council held a Special Meeting of its Standards Committee on Wednesday, 10th January, 2024.

It involved two Councillors, Gwynfor Owen and Dawn Jones asking for special dispensation to be allowed to join the Task and Finish group that is to be set up to look into Gwynedd's Autism Plan. 

The two Councillors have worked with and have experience of those with autism and other Councillors supported their inclusion to the group. But the monitoring officer, Iwan G D Evans, 'advised' them that there was a prejudicial interest to their inclusion.

Task and Finish panels have no vote, nor do they allocate any funding so why the monitoring officer initially advised against the councillors makes no sense...

The committee granted both Councillors dispensation to join the task and finish group.

This special meeting will have incurred costs to the council and Councillor Owen had to give his evidence whilst on holiday in Spain.

Cyngor Gwynedd Council - Falsus In Uno, Falsus In Omnibus

Cyngor Gwynedd council have now appointed Huw Dylan Owen as Director of Social Services. The former Director had no experience of social service matters so someone with the correct background for the position hopefully meant that the past maladministration and failings within the services would not be repeated...

Bearing in mind, that Gwynedd council have admitted that the culture within the council needs to change, it is disappointing that the present director appears to be behaving in the same manner as his predecessor. In his annual report, presented to the council earlier this year, he states - .
...no young person from Gwynedd has been remanded since 2020.

This is not true and while the council may argue this was correct at the time of writing - it was most certainly not at the time of publication. Mr Owen's generic report also states -
Another example is that we refused to welcome Youth Justice inspectors as they were unable to guarantee bilingual inspectors, and they agreed to delay their inspection until this was possible.

How long ago was the last inspection?
It is unacceptable that the youth justice inspectors are not bilingual, but this does mean that the service avoids inspection by an outside agency and should be of concern to all...

Moving on, Mr Owen mentions feedback and recommendations from government regulators, perhaps not realising Gwynedd council has a history of agreeing to recommendations and then ignoring them...

The director goes on -
Unfortunately, cases have arisen where things go wrong and where we have not provided a service of the expected high standard. There is a statutory complaints procedure in place to ensure that we receive feedback, and respond to any concerns so that we do not repeat mistakes. Reference has already been made to the main trends of the complaints for this year, and an official summary will appear before the Care Scrutiny Committee in September 2023. We intend to place our complaints report and comments on the Council’s website in the future so that they are available to the public.

Gwynedd council's democratic services were recently asked for a copy of the report that the director informed at a previous meeting was available for members on request. It took a second email asking for an update to which an officer replied with -

The annual Social Services complaints handling reports have been presented to Cabinet and Scrutiny in the past but the reports for 2022/23 are yet to be scheduled to be presented to a committee meeting.

This word salad from the democracy service ignores the fact that the statutory documents have not been presented for proper scrutiny for nearly five years and confirms yet another statement from the director's report that is incorrect.

The children and adults complaints handling reports are important documents. Alongside the Director's Annual report they are the first documents to be read by government agencies as a snapshot of how the departments are performing. They may also be read by investigators when more serious concerns are raised.

A reminder that these reports have been called out for their disingenuity and data manipulation since 2016 and no complaints handling report has been presented to the care scrutiny committee since 2019...

One Councillor Was Asleep - Cyngor Gwynedd Council.

On the 10th, February, 2022, Cyngor Gwynedd Audit and Governance Committee sat to discuss the Saint David's Day Celebration, the revenue budget review, savings schemes, the budget and Audit Wales reports.

As in most meetings, the councillors had few questions for officer's and the presented data - the most significant challenges coming from Sharon Warnes, the lay member of the committee.

One councillor fell asleep during the meeting...

Part of the Audit Wales report highlighted that the council was developing a new 'performance arrangement framework'...but that communication with and training for councillors has not been effective enough. No kidding... .

The Audit Wales officer was asked for his opinion of scrutiny during the meeting - he just laughed...

The same officer presented the 2019 report to council where he had raised concerns with the provision of youth services - that old chestnut. It was not a meeting the officer would have enjoyed. Remembering that, the officer may have been thankful to be attending via Zoom rather than in the council chamber, but councillors were still heard to make remarks...

Cyngor Gwynedd Council - When Is Compliance Compliance ?

On the 23rd, December, 2021 the Ombudsman for Wales wrote regarding Cyngor Gwynedd council's compliance - or rather non compliance - with recommendations from a 2019 investigation into the children's SS department.

"In relation to compliance I had also chased the Council in the interim for confirmation as to the outcome of the Cabinet meeting on 30 November (having not had any update). I received its response yesterday morning. I have also today been able to see the minutes of that Cabinet meeting on its website and confirmation that the plan was approved. Having considered the question of compliance, we are content that the Council has met this as a varied implementation from the strict wording of the recommendation as set out.

Think on that - the Ombudsman had to chase the council for confirmation and then checked the minutes of the meeting to confirm the council's confirmation..Lessons learnt?

But what is this 'varied implementation from the strict wording'?

 

On October 22, 2020, the Ombudsman shared his thoughts on what was expected of the council to meet compliance...-

Re the Derwen eligibilty criteria - Why does Hugh Morgan, OBE,  recommend a 'further (and immediate)' review? An Ombudsman's investigation from 2019 recommends - 

 

70. The Council should review its Derwen policy to ensure its criteria aligns with the Social Services and Wellbeing (Wales) Act 2014 and the Equality Act 2010’s definition of ‘disability’, and ensure staff are informed about any changes (within three months).

 

The Ombudsman has signed this off as completed. So why is the consultant calling for a further review only one year later? By this time, there should be two reviews into Derwen - where are they?

Just before Christmas, the Derwen manager, Aled Gibbard, was asked to share the autism data collected with Councillors of the Care Scrutiny Committee. Apart from a vague 1 in 100 figure he produced no local data. Why not? Why not simply collate all the data from the agencies that have been working together since 2008.

 

Hugh Morgan's review makes mention of 'ring fenced' (and non ring fenced) monies for these services over the same period. By my estimation, there is £680,000 worth of data - where is it?

 

The 'plan to be launched by April, 2021' has still not been launched.

Anyway it is not a plan - it is simply a copy and paste presented by the contact officer, Aled Gibbard,  of Hugh Morgan's review and recommendations . The Equality Impact Assessment also undertaken by Mr Gibbard is mostly a copy and paste of Welsh Government's Code of Practice Equalty Impact Assessment. 

 

Regardless - the Ombudsman has signed it off...

Cyngor Gwynedd Council - 'it would frighten you how few members of staff undertake these trainings..'

Cyngor Gwynedd council's Care Scrutiny Committee meeting held on the 25th November, 2021 was interesting on so many levels....

All councillors on the committee bar two, were emailed calling out the Autism plan as a cut and paste of Hugh Morgan's, review summary and recommendations. Only one response was received and 6 councillors excused themselves on the day as not able to attend the virtual meeting. Gwynedd council's 'public' webcast does not include the start of the meeting where those apologies were given.

Moving on, the Cabinet Member for Children and Families, Dilwyn Morgan, talks about the difficult times during the pandemic but sees the autism plan produced during these times with 'pride'. He also mentions the importance of listening to young people and their families...

The councillor appears to have forgotten that in 2018, he, along with the children's senior complaints manager, refused point blank to discuss an investigation into this case with the Care Scrutiny Committee. Has he also forgotten the email exchanges he had with a family who raised issues of bad behaviour by officers where he stated in relation to the first Ombudsman's investigation that the council has 'accepted and acted upon his recommendations' ?
This was not correct...

It is also a matter of concern that issues were raised with the Cabinet member regarding the accuracy of annual SS complaints handling reports written by the children's department. A SAR has revealed that the Cabinet Member did indeed discuss the matter - not with the council's democratic services as one may expect but with the senior complaints manager for children and families.  The conversation does mention that a corporate complaint could have been made, but the email exchange has been so heavily redacted by Gwynedd's Information Manager that the remainder of the conversation is unreadable.

Regardless, the Cabinet Member did not pass on that information...Sshh...

During the webcast, Dilwyn Morgan attempts to blame the system for the deficiencies highlighted by the various investigations and implies that he and the officer's will 'sort it out'.
The same people who ignored their responsibilities under the Autism SAP, the Equality Act 2010, the SSWB (Wales) Act 2014, NICE guidelines, code of ethics et al and ignored the SS complaints procedure (in order to squash complaints)...will now sort it out. Right oh...

Regarding the training of members and staff, the Cabinet member states - "it would frighten you how few members of staff undertake these trainings..."

Imagine what it is like for people on the receiving end of these untrained staff - from a Head of Services that does not know what the Equality Act,2010 is to a Gwynedd social worker who 'suggested' parents setting up an autistic child up to 'fail' re safeguarding  - "I can't help him otherwise..."

He also states that the situation is more difficult and far worse in other counties of Wales. Which counties are those, Mr Morgan and have you raised concerns ?

And where was the voice of the Cabinet Member for Adults, Dafydd Meurig ? Still sitting on an Ombudsman's report where an autistic young man was left to rot in bed when his commissioned hours were taken from him and the staff used elsewhere in the home to cover for its own staff shortages...

Cyngor Gwynedd Council - Handling Of FOI Requests Under The Law.

Browsing through Freedom of Information requests made to Cyngor Gwynedd council makes for some interesting reading...

In 2018/19, an FOI request with regard to the Education department titled 'Additional Learning Needs and Inclusion Service' brought about an interesting interchange which included -
Perhaps you would like to explain why it is that you have told me that 1507 children are currently on the register yet in response to the same question being asked less than a month later by another interested party they claim not only to have received the information before I did but that the information given to them was that there are in fact 2621 children on the ALN register.
The request for an Internal review appears to have been ignored.

More recent requests include - 'Council Expenditure or Payment to Suppliers from January to June 2021' with regard to Health and Social Care. Now this was first asked for in August but was not responded to correctly and the information officer has now stated the information will be made available on the 25th of November. We shall see....

Other requests include - 'FOI Request For Vacant Crofts In Gwynedd Council Area'. The Information officer replied that the council did not hold this information. The requester replied - 'I find it difficult to understand that the council down(sic) not have information on the small holdings or crofts it owns in its own council area. If the council does not know what it owns then who would know?'
The requester then asked for an Internal Review but the account is now suspended so presumably the review will not now be undertaken.

'Technical Difficulties...' Cyngor Gwynedd Council.

Two years have passed since Cyngor Gwynedd council agreed to implement the recommendations of an Ombudsman for Wales investigation yet the council remain in non compliance...

The last CEO of the council had told councillors that all recommendations had been met 'bar a nuance' - this was not correct.

The present CEO was meant to have had a meeting with the Ombudsman in which he was to provide the Ombudsman with an update and discuss issues around compliance. Unfortunately.... 'technical difficulties' meant the meeting had to be abandoned. Why the CEO could not update the Ombudsman by telephone or email remains unclear.

It has also been over two years since the Ombudsman for Wales sent two of his officers to North Wales to take a complaint in relation to non compliance with yet another Ombudsman's investigation.

                                     

The officer's explained they could not take this complaint as the Ombudsman's office had already signed off compliance without really understanding what was required of the council. The Ombudsman has apologised for the actions of the officer who signed it off.

The Ombudsman's investigator also refused to take a complaint against the social worker involved in the Stage 2 complaint investigation that senior managers of the council interfered with as the SW may have forgotten what happened....and may deny the charge..!!!

Instead, the Ombudsman wished to focus on the assessment undertaken by Gwynedd council in response to a recommendation from his previous investigation.

Concerns had been raised with the Ombudsman that the council would not treat the assessment fairly and we asked that an independent social worker be assigned. The request was refused and the council then tasked Sharon and Barry with conducting the assessment. It has come to light that Barry was not there for the assessment and one can only wonder why he was involved in the process.

The assessment carried out ended up an exercise in parent blaming...

Questions remain of who was actually in charge of the assessment. The assessor visited the parents to inform the assessment was complete before flying off to holiday in Florida the next day. Yet comments made after this have found their way into the file. Which manager in the SS department was responsible for the handling of this assessment ? A SAR (subject access request) was requested but Gwynedd council's information manager has heavily redacted the information to the extent it is unreadable. Sshh...

Gwynedd Council - Application For Indemnity By A Councillor Under The Council's Policy

There is to be a special meeting of Cyngor Gwynedd Council's Standards Committee on Tuesday, 26h October, 2021. 

4. EXCLUSION OF PRESS AND PUBLIC
The Chair shall propose that the press and public be excluded from the
meeting during the discussion on the following item due to the likely
disclosure of exempt information as defined in paragraph 18C, Part 4,
Schedule 12A of the Local Government Act 1972. This paragraph should
apply because it concerns the deliberations of the Standards Committee in
reaching a finding on a matter referred to it by the Public Services
Ombudsman for Wales.

It is believed that the information should not be disclosed so that the
councillor is not prejudiced by any possible publicity of the case before any
hearing. Consequently the public interest in maintaining the exemption
outweighs the public interest in disclosing the information.

5. APPLICATION FOR INDEMNITY BY A COUNCILLOR UNDER THE
COUNCIL'S POLICY

Are both matters related ?
Usually these cases are simple spats between councillors and mostly unimportant...

But a councillor asking for indemnity is not usual - is it ?

 

Gwynedd Council - "for a local authority to behave in the way described by the ombudsman towards independent investigators is shocking"

Has the 2020/21 Children and Families Annual Complaints Handling Report circumvented Gwynedd council's Care Scrutiny Committee and any issues that councillors may have wished to raise ?

The last complaints report to go before scrutiny was in 2019 and that was not a meeting the senior complaints officer would have enjoyed. The Committee asked for more detail than usual and the officer made several references to the Ombudsman for Wales. The Ombudsman has since denied the words of the officer.

The latest report, authored by the Head of Children's SS refers back to the June, 2019 Ombudsman's report and writes -  "...recommendation asked the Department to look at the pathway within the Children’s Service in relation to Autism."

There is no pathway - that is the point.
The Ombudsman for Wales recommendation from the investigation dated June, 2019 is quite clear - 
71.The Council should (within three months) seek specialist input to develop a plan for dealing with future assessment and support requests from/for those suffering with Autism.

Under 'lessons learnt' -
"Moving forward, we have learnt an important lesson. At the first point of contact, we need to ensure that we read and understand the report and recommendations..."

Another recommendation from the same Ombudsman's report was -
68. The Council should, through its Chief Executive, apologise in writing
to Mr & Mrs A (and through that letter to X for failings...).
The apology must cover the following matters:
• the delay in providing its response to their complaint.
• the officer’s apology for distress caused by his comments.
• the failure to review X’s child in need plan.
• the other failures identified above.

The 'other failures identified above' include the circumstances that led to an investigating officer feeling 'overwhelmed' and 'bullied' at a meeting which the Head of the Children's department chaired.

Evidence from the council is noted as 'disingenuous' in the Ombudsman's report that also found senior officers had indeed interfered with an 'independent' investigation. Four/five pages were deleted from the original report - these pages included criticism of officer's and departmental failings.

It must be remembered that this investigation was hampered by the council informing the investigators that one officer involved had left the council and so could not be questioned. Once the investigation had concluded the officer then rejoined the council. What of the officer's continuity of employment ?

Luke Clements is the Cerebra Professor of Law and Social Justice at the School of Law, Leeds University. In 2013 he was the Special Adviser to the Parliamentary Committee that scrutinised the draft Bill that resulted in the Care Act 2014.

He wrote an article on the case -
Hopefully the local authority in question will implement the ombudsman’s recommendations and take a long hard (and reforming look) at the organisational culture that allowed these deplorable events to occur.

This report is incredibly troubling on many levels – not least that a local authority had so clearly failed to understand its legal obligations.  What is (to an outside observer) of most concern, is the level and nature of challenge experienced by the IIO.  We are well aware of families being fearful of the consequences of complaining – fearful of retaliatory action by authorities – but for a local authority to behave in the way described by the ombudsman towards independent investigators is shocking.  Complaints’ investigators are acting on behalf of Chief Executives / council members.  For a culture to develop where such an investigator considers that she is being bullied and for the ombudsman to agree that the impression given was of a council seeking to influence the outcome of an independent review – strikes at the very heart of the review process.  Ultimately senior legal officers and council members are responsible for the organisational culture of their authority – and these officers / members should take a long hard look at this report.

Gwynedd Care Scrutiny Discuss Report Into Embargo On Care Homes.

5 Gwynedd Care Homes Placed Under 'Escalating Concerns Procedure'.

Cyngor Gwynedd Council have published a report that went before the Care Scrutiny Committee on the 30th, Sept, 2021 entitled - The Quality Assurance Service within the Safeguarding Unit.  

The purpose of this report is to offer an overview of the work of the Quality Assurance Unit within the Adults, Health and Well-being Department of Gwynedd Council. It is intended to focus on the demand and the impact of the work in the context of providing care services for vulnerable residents in the County.

Towards the end of 2020, several safeguarding reports were received claiming that suitable care was not being provided within five homes in the County. In response to this, face-to-face monitoring was undertaken and three care homes and two nursing homes within the county were placed under the Escalating Concerns procedure.

Owing to the monitoring work, an embargo on new placements was imposed on the five homes, and two now have a conditional embargo in terms of the number of new residents who may be admitted.

If any provision under-performs and that an embargo on admissions or placements is in place, it has a significant impact on the area teams in terms of their ability to place or use that service. It also has a significant effect on the individuals and their families as it is not always possible to place people within their preferred area or receive a specific service in their community in a timely manner.

The report states that one nursing home and two care homes have closed in Gwynedd over the past two years and concludes with mentioning the Magaret Flynn Review (2012) and the Winterbourne View Hospital scandal - twice. Why reference institutional abuse of those with autism and learning difficulties in a care setting from a decade ago ?

"No Matter What The Wish Of The Individual May Be" - Cyngor Gwynedd Council.

With regard to the previous post, the Corporate Director of Cyngor Gwynedd council SS departments, Morwena Edwards, has given her explanation of the statements made to the Care Scrutiny Committee by the CEO, Dilwyn Williams and the senior complaints manager, Dafydd Paul, in particular - bearing in mind the Ombudsman for Wales has denied instructing the council.

Interesting wording - and they were anything but queries...
Morwena continues - 
"However, the Ombudsman’s office was clear that they expected us to be pro–active in response to their findings that we provide these assessments.After obtaining legal advice, our interpretation of the Ombudsman’s recommendation led us to conclude that contacting you directly to offer you and your family the comprehensive assessment of your needs referred to above was the most appropriate course of action. This action was taken in good faith as part of our sincere effort to meet the terms of the Ombudsman’s recommendation.I wish to sincerely apologise for the confusion and distress that the subsequent telephone call to you on 14/11/19 caused, and I accept that we should have taken into account that you had previously requested that communication between your family and the Council should only be conducted via email.In response to your second point above,  

I acknowledge that the quote from the transcript you provided of Mr Paul’s statement to the Care Scrutiny Committeeon 14/11/19 is what was conveyed to the Committee."

So did the senior complaints manager mislead Councillors of the Committee?

"However, I must disagree with your assertion that his statement was made deliberately to mislead the Committee in some way about how Gwynedd Council were intending to meet the Ombudsman’s recommendations contained in his report." 

But, if the Ombudsman had given the council no such instruction why did the officer spend so much time telling Councillors that he had ?
"...the Ombudsman has judged this and wants us to go no matter what the wish of the individual may be..."

"Mr Paul’s statement to the Committee is consistent with the prevailing interpretation of this specific recommendation from the Ombudsman by Gwynedd Council at that time. In order to meet the recommendation, we decided that all methods be explored in order to comprehensively assess your family’s needs."

'...consistent with the prevailing interpretation...' What. does. that. even. mean ?
Regardless - the Ombudsman has denied the words of Dafydd Paul -

"given them a further challenge, to make sure that someone goes to see the family, meet the family, ensure that they receive that assessement and that is something that we have now arranged with the adult services, to go into that situation on the Ombudsman's behalf, despite the fact that they have not expressed a wish to receive the service, our usual ethos involves intervention but only if the person invites us in and wishes for us to intervene in this way, the Ombudsman has judged this and wants us to go no matter what the wish of the individual may be, so that is now our response to that challenge provided by the Ombudsman." (translated)

Morwena Edwards continues -
"The action of being proactive in offering you and your family these assessments was seen as vital to meeting the Ombudsman’s directions, and was interpreted as being a requirement implicitly arising from that recommendation." 

There is that word 'interpretation' again. Anyway the recommendation referred to has been ignored since 2010, and again in 2017. Two social worker's were assigned to carry out that task in 2018, alongside another Ombudsman's recommendation. After completing one piece of work - badly - they did not return as they had said they would.

The Ombudsman has called the Director's thinking as 'illogical' in a past investigation. What could be said now ?

Something is seriously wrong within Gwynedd council.
