Director of Cyngor Gwynedd Council Social Services To Leave Post.

More change at Cyngor Gwynedd council as the Director of Social Services is leaving...

Morwena Edwards, whose background is finance was employed as Director of Adult and Children's Social Services in 2012.

The Director of Gwynedd SS is to leave her post in the summer - a year after the Chief Executive Officer retired..

To lose a chief executive officer in the midst of a pandemic was...unfortunate. To lose two such senior officers in just over a year suggests every officer for themselves...

Is another scandal about to come to light?

Gwynedd Council - Family 'Under Siege' In Nefyn Granted Planning Permission.

During the pandemic, Welsh Government passed new laws and policies to enable more public participation in local authority proceedings. Hybrid zoom meetings with some councillors in the chamber and some at home will become the new normal.

Though all council meetings have been recorded since the pandemic very few have been uploaded to Gwynedd's website for viewing by other councillors and the public.

Members of the Education and Economy Scrutiny Committee were to hear back from the senior Education officer regarding the video circulated on social media that appeared to show the headmaster of a local school grab a pupil by the neck. The last meeting of this committee was cancelled - have members of the committee been updated ?

The question of why Neil Foden complained to the press that he had been 'thrown under a bus' by the council over the school meals fiasco has still not been answered.

Senior Operations Manager Aled Gibbard presented the Care Scrutiny Committee with the Council's 'Autism Plan' on November the 25th 2021.

Observations submitted by members included the following  - "There was a desire to receive an information session for Councillors in order to improve understanding of the field. It was reiterated that this training should be held before April 2022"

Have Councillors received this 'training' session ?

Also - "The annual review of the Plan was welcomed by Members adding that there was a strong desire to receive an update before April 2022."

Have Members received that update ?

Moving on - the annual complaints handling reports of Gwynedd social services has not been presented for scrutiny since before the pandemic. The last Children's report was presented in 2019, by Dafydd Paul. A complaint was raised with the council that the officer had misled the committee but this complaint was downgraded to an 'enquiry' by the Director  of SS who dealt with the complaint personally and so details will not be logged - presumably...

The Adult and Children departments are responsible for the most vulnerable people in society. We have had two years of a pandemic - many have died - social care is in crisis. Why no scrutiny?

In other news - Councillors of the Planning Committee complained that planning policies were not fit for purpose....

Two proposals which the planning department refused have now been overturned by councillors. Planning permission to create a home from a ruin by a local resident was granted. The other was more controversial and worries of intervention by the Welsh Government were raised.

Some councillors appeared to know the applicant and spoke of the family's troubles. Mention was made that the family already own an ex council home in Nefyn but that the family have been experiencing abuse from some in their community which is now affecting their children.

The story of anti-social behaviour and concerns for their mental health, portrayed by one councillor as a family 'under siege' was enough to sway councillors and the application was passed.

One Gwynedd Councillor Continued To Work In His Shed During The Meeting....

On Thursday, 17th February, 2022, Cyngor Gwynedd council held a Democracy Services Committee meeting. The agenda can be found here -

There was an update on the May elections, an update on hybrid meetings, a diversity in democracy report, a Democratic Services team performance report, and the increase in salaries for Councillors were all discussed. After each report, a vote was called for and each one passed...

One councillor was present but not really present. He had taken the laptop into what looked like his workshop for the Zoom meeting and spent most of it pottering around away from the screen. He was shouted at to get his attention and asked how he was voting on the first report - he voted to accept. He then returned to his project and took little part in the rest of proceedings.

Regarding the increase of salaries to councillors only one councillor objected and voted against. She thought it disgusting with the cost of living crisis now hitting residents hard. It was explained that this was the recommendation from a renumeration panel...

Democratic services raised the following in one report -  

This is the experience of the Deiniol Ward Councillor, who has decided not to stand again in the May elections. He was very clear in an article published by the Bangor Aye -

“The largest part of the decision not to stand probably comes from the boundary changes. For those who don’t know, several new ‘mega-wards’ have been created in Bangor which only take account of the small number of registered voters, but take no account of the amount of businesses, infrastructure and 10,000 students population (plus most of the university campus) which fall in the new ward.".

He continued - 

“It’s also been a strange 5 years in the world of electoral politics, which I must admit was never my natural home. Elections – whether local or national – don’t change things much because the institutions we get elected to are tied into far too many patterns and systems that are designed to halt real change whilst keeping the money and the real power in the hands of a very small number of self-serving and corrupted people".

Cyngor Gwynedd Council - Harassment In Schools.

On the 8th February, 2022, Cyngor Gwynedd council held an Education and Economy Scrutiny Committee meeting. The agenda for the meeting can be found here -

There have been incidents and the situation is being monitored...

What of the video of a Headteacher appearing to have a child by the neck? The same Headteacher who caused the social media backlash on school dinners - but then accused the council of throwing him under a bus...

The Education officer thanked the committee for the question and said he would get back to them....

Why the headteacher accused the council of throwing him under the bus was asked at the Education Scrutiny Committee meeting but the Cabinet Member for Education, Cemlyn Williams, did not answer the question. Instead, he chose to focus on his perception that he was being compared to Boris Johnson. The Education officer simply wished to be 'moving forward'

SEXUAL HARASSMENT IN SCHOOLS
Whilst acknowledging there is a problem, there was again very little in the way of data. The main data coming from a UK website on bullying and harassment...

Where is the local data? The schools must have recorded incidents - why was that data not presented? Why is there no data from Gwynedd Youth Justice. The Police - Governors - Pupils - Parents?

With regard to the Economy report - the data driving future works in the county appears to come from a survey undertaken by the council. There were less than 160 responses...Of those some were critical of the lack of youth provision in Gwynedd - this criticism does not appear in the council report...

Regardless, the committee passed the reports...

Cyngor Gwynedd Council Scrutiny Committee Pass What Exactly...?

Cyngor Gwynedd council's Care Scrutiny Committee met on the 3rd February, 2022, to receive a progress report on the Occupational Therapy service and also to scrutinise the North Wales Population Needs Assessment.

Whilst the OT report was quite encouraging, if accurate - the Needs Assessment had not been completed.
The officer blamed the pandemic and a lack of data but promised the report will be ready to be presented to the Cabinet next week. So no proper scrutiny then?
Regardless, a vote on the report that was not a report was called for....!!!

A debate ensued - well sort of...
There appeared to be a plea for councillors to help in the collecting of data - then it was said there is enough data...!!
Concerns were raised that few people were responding with requests for information - surveys etc and were there mumblings that the data was not positive to the services?

The meeting bemoaned the fact not enough people are engaging to aid with data collection. But families have tried to engage and are ignored...or parent bashed. Councillors of the Scrutiny Committee have been made aware of the concerns for those with protected characteristics (and the data) for several years now - the committee has not engaged. Are members now asking for those with past experience of council services to come forward? It was all very confusing...

Have any of the five recent Ombudsman's investigations been used to inform the Assessment? Has the Hugh Morgan, OBE review been used - apart from the cut and paste 'plan' presented to the last Scrutiny meeting?

Have we reached the point where departmental reports and data are in complete contradiction to recent investigations, reviews and people's personal experiences?

One of the counci's most important pieces of work to plan services for the next 5 years is being bodged...For why? The data is worthless....

Only one committee member saw through it all and voted against accepting the report, one other abstained - the rest voted it through....

Cyngor Gwynedd Council - When Is Compliance Compliance ?

On the 23rd, December, 2021 the Ombudsman for Wales wrote regarding Cyngor Gwynedd council's compliance - or rather non compliance - with recommendations from a 2019 investigation into the children's SS department.

"
In relation to compliance I had also chased the Council in the interim for confirmation as to the outcome of the Cabinet meeting on 30 November (having not had any update). I received its response yesterday morning. I have also today been able to see the minutes of that Cabinet meeting on its website and confirmation that the plan was approved.
Having considered the question of compliance, we are content that the Council has met this as a varied implementation from the strict wording of the recommendation as set out.

Think on that - the Ombudsman had to chase the council for confirmation and then checked the minutes of the meeting to confirm the council's confirmation..Lessons learnt?

But what is this 'varied implementation from the strict wording'?

 

On October 22, 2020, the Ombudsman shared his thoughts on what was expected of the council to meet compliance...- 

 

Mr Bennett went on -

 

The Transitional Social Worker has still not been employed.

 

Re the Derwen eligibilty criteria - Why does Hugh Morgan, OBE,  recommend a 'further (and immediate)' review? An Ombudsman's investigation from 2019 recommends

 

70. The Council should review its Derwen policy to ensure its criteria aligns with the Social Services and Wellbeing (Wales) Act 2014 and the Equality Act 2010’s definition of ‘disability’, and ensure staff are informed about any changes (within three months).

 

The Ombudsman has signed this off as completed. So why is the consultant calling for a further review only one year later? By this time, there should be two reviews into Derwen - where are they?


Just before Christmas, the Derwen manager, Aled Gibbard, was asked to share the autism data collected with Councillors of the Care Scrutiny Committee. Apart from a vague 1 in 100 figure he produced no local data. Why not? Why not simply collate all the data from the agencies that have been working together since 2008.

 

Hugh Morgan's review makes mention of 'ring fenced' (and non ring fenced) monies for these services over the same period. By my estimation, there is £680,000 worth of data - where is it?

 

The 'plan to be launched by April, 2021' has still not been launched.

Anyway it is not a plan - it is simply a copy and paste presented by the contact officer, Aled Gibbard,  of Hugh Morgan's review and recommendations . The Equality Impact Assessment also undertaken by Mr Gibbard is mostly a copy and paste of Welsh Government's Code of Practice Equalty Impact Assessment. 

 

Regardless - the Ombudsman has signed it off...

Cyngor Gwynedd Council - 'it would frighten you how few members of staff undertake these trainings..'

Cyngor Gwynedd council's Care Scrutiny Committee meeting held on the 25th November, 2021 was interesting on so many levels....

All councillors on the committee bar two, were emailed calling out the Autism plan as a cut and paste of Hugh Morgan's, review summary and recommendations. Only one response was received and 6 councillors excused themselves on the day as not able to attend the virtual meeting. Gwynedd council's 'public' webcast does not include the start of the meeting where those apologies were given.

Moving on, the Cabinet Member for Children and Families, Dilwyn Morgan, talks about the difficult times during the pandemic but sees the autism plan produced during these times with 'pride'. He also mentions the importance of listening to young people and their families...

The councillor appears to have forgotten that in 2018, he, along with the children's senior complaints manager, refused point blank to discuss an investigation into this case with the Care Scrutiny Committee. Has he also forgotten the email exchanges he had with a family who raised issues of bad behaviour by officers where he stated in relation to the first Ombudsman's investigation that the council has 'accepted and acted upon his recommendations' ?
This was not correct...

It is also a matter of concern that issues were raised with the Cabinet member regarding the accuracy of annual SS complaints handling reports written by the children's department. A SAR has revealed that the Cabinet Member did indeed discuss the matter - not with the council's democratic services as one may expect but with the senior complaints manager for children and families.  The conversation does mention that a corporate complaint could have been made, but the email exchange has been so heavily redacted by Gwynedd's Information Manager that the remainder of the conversation is unreadable.


Regardless, the Cabinet Member did not pass on that information...Sshh...

During the webcast, Dilwyn Morgan attempts to blame the system for the deficiencies highlighted by the various investigations and implies that he and the officer's will 'sort it out'.
The same people who ignored their responsibilities under the Autism SAP, the Equality Act 2010, the SSWB (Wales) Act 2014, NICE guidelines, code of ethics et al and ignored the SS complaints procedure (in order to squash complaints)...will now sort it out. Right oh...

Regarding the training of members and staff, the Cabinet member states - "it would frighten you how few members of staff undertake these trainings..."

Imagine what it is like for people on the receiving end of these untrained staff - from a Head of Services that does not know what the Equality Act,2010 is to a Gwynedd social worker who 'suggested' parents setting up an autistic child up to 'fail' re safeguarding  - "I can't help him otherwise..."

He also states that the situation is more difficult and far worse in other counties of Wales. Which counties are those, Mr Morgan and have you raised concerns ?

And where was the voice of the Cabinet Member for Adults, Dafydd Meurig ? Still sitting on an Ombudsman's report where an autistic young man was left to rot in bed when his commissioned hours were taken from him and the staff used elsewhere in the home to cover for its own staff shortages...

Something is so very wrong within Gwynedd council...

Cyngor Gwynedd Council - Handling Of FOI Requests Under The Law.

Browsing through Freedom of Information requests made to Cyngor Gwynedd council makes for some interesting reading...

In 2018/19, an FOI request with regard to the Education department titled 'Additional Learning Needs and Inclusion Service' brought about an interesting interchange which included -
Perhaps you would like to explain why it is that you have told me that 1507 children are currently on the register yet in response to the same question being asked less than a month later by another interested party they claim not only to have received the information before I did but that the information given to them was that there are in fact 2621 children on the ALN register.
The request for an Internal review appears to have been ignored.

More recent requests include - 'Council Expenditure or Payment to Suppliers from January to June 2021' with regard to Health and Social Care. Now this was first asked for in August but was not responded to correctly and the information officer has now stated the information will be made available on the 25th of November. We shall see....

Other requests include - 'FOI Request For Vacant Crofts In Gwynedd Council Area'. The Information officer replied that the council did not hold this information. The requester replied - 'I find it difficult to understand that the council down(sic) not have information on the small holdings or crofts it owns in its own council area. If the council does not know what it owns then who would know?'
The requester then asked for an Internal Review but the account is now suspended so presumably the review will not now be undertaken.

How many more FOI requests are not being treated according to law - and more importantly why ?

Application For Indemnity Refused - Cyngor Gwynedd Council.

With regard to the article, dated 20th October, in which a councillor asked Cyngor Gwynedd council for indemnity under the council's policy. 

The Standards Committee published a decision notice on the 26th October declining the request - 

Having looked very carefully at the application, and considering Gwynedd Council's Indemnity Policy attached as Appendix 1 to the report submitted to the committee, the Chair should write to inform the member that the Standards Committee is not in a position to offer him indemnity in relation to legal representation at a hearing of the Standards Committee.
The case the councillor is defending deals entirely with
his role as a Town Council Councillor. Any decision would impact on that role only, and would not have any affect on the councillor's role as a member of Gwynedd Council.

Does this relate to the discarded file of various documents ? One of the councillors named has previously made a complaint against a fellow councillor which was upheld. 

That case involved a councillor who wrote in his blog that a local person “intended to retire soon...and stand for election to the council in a seat held by another councillor”.

The Appeals Tribunal, found these allegations to be “factually untrue and unfounded” and the councillor was then suspended from Gwynedd council for three months.

The local person then stood for council and was elected....
So what on earth is going on now....?

'Technical Difficulties...' Cyngor Gwynedd Council.

Two years have passed since Cyngor Gwynedd council agreed to implement the recommendations of an Ombudsman for Wales investigation yet the council remain in non compliance...

The last CEO of the council had told councillors that all recommendations had been met 'bar a nuance' - this was not correct.

The present CEO was meant to have had a meeting with the Ombudsman in which he was to provide the Ombudsman with an update and discuss issues around compliance. Unfortunately.... 'technical difficulties' meant the meeting had to be abandoned. Why the CEO could not update the Ombudsman by telephone or email remains unclear.

It has also been over two years since the Ombudsman for Wales sent two of his officers to North Wales to take a complaint in relation to non compliance with yet another Ombudsman's investigation.

                                     

The officer's explained they could not take this complaint as the Ombudsman's office had already signed off compliance without really understanding what was required of the council. The Ombudsman has apologised for the actions of the officer who signed it off.

The Ombudsman's investigator also refused to take a complaint against the social worker involved in the Stage 2 complaint investigation that senior managers of the council interfered with as the SW may have forgotten what happened....and may deny the charge..!!!

Instead, the Ombudsman wished to focus on the assessment undertaken by Gwynedd council in response to a recommendation from his previous investigation.

Concerns had been raised with the Ombudsman that the council would not treat the assessment fairly and we asked that an independent social worker be assigned. The request was refused and the council then tasked Sharon and Barry with conducting the assessment. It has come to light that Barry was not there for the assessment and one can only wonder why he was involved in the process.

The assessment carried out ended up an exercise in parent blaming...

Questions remain of who was actually in charge of the assessment. The assessor visited the parents to inform the assessment was complete before flying off to holiday in Florida the next day. Yet comments made after this have found their way into the file. Which manager in the SS department was responsible for the handling of this assessment ? A SAR (subject access request) was requested but Gwynedd council's information manager has heavily redacted the information to the extent it is unreadable. Sshh...

Inaccurate And Misleading ? - Gwynedd Council - Ysgol Abersoch

Cyngor Gwynedd Council's Education and Economy Scrutiny Committee met on 21/10/21 to discuss the closure of Ysgol Abersoch. The decision to close the small school in December has caused much tension between locals and the council.

Concerns have been raised that the majority of the consultation process has happened during the Covid19 pandemic and that the council's report was inaccurate and misleading...

The Cabinet Member for Education, Cemlyn Williams, is confident the process has been fair.
Can the same be said of other processes the Ed department has been involved with ? Are critical reports being sat on by this department, too ?

With the meeting going nowhere, Councillor Judith Humphreys proposed sending the matter back to the Cabinet.  This did not go down well and an amendment was raised by Dewi Roberts, Councillor for Abersoch, who asked for the matter to go before full Council to hear the views of all Councillors.

Things then became a little surreal. During the vote on referring the matter to full council - one lay member seemed to freeze and stated she did not know what to do and asked for help. Democratic services had to intervene saying she could not be advised how to vote. The lay member voted against referring to full council and the amendment fell by the one vote.

The proposal to send the matter back to Cabinet - from whence it came - was passed.

Gwynedd Council - Application For Indemnity By A Councillor Under The Council's Policy

There is to be a special meeting of Cyngor Gwynedd Council's Standards Committee on Tuesday, 26h October, 2021. 

4. EXCLUSION OF PRESS AND PUBLIC
The Chair shall propose that the press and public be excluded from the
meeting during the discussion on the following item due to the likely
disclosure of exempt information as defined in paragraph 18C, Part 4,
Schedule 12A of the Local Government Act 1972. This paragraph should
apply because it concerns the deliberations of the Standards Committee in
reaching a finding on a matter referred to it by the Public Services
Ombudsman for Wales.


It is believed that the information should not be disclosed so that the
councillor is not prejudiced by any possible publicity of the case before any
hearing. Consequently the public interest in maintaining the exemption
outweighs the public interest in disclosing the information.

Usually these cases are simple spats between councillors and mostly unimportant...

"And I do wonder if it’s because of the attitude we have of senior officers to some of the councillors." - Gwynedd Council.

Cyngor Gwynedd Council's Cabinet Meeting took place on the 12th October. The autism plan was not passed and implemented as the Ombudsman for Wales was expecting - it was not even mentioned. 

Moving on - the Cabinet meeting included discussion on the Corporate Complaints Report. It appears that this complaints process, like the Social Service complaints procedures, is undergoing much change too. The Ombudsman is involved with these changes BUT the problems are not just with the complaints process and procedures more how senior officer's interfere with the process...
"The meeting was not to try and influence the outcome of the report in anyway..."

 
How has the complaints process been allowed to stray so far from the original Welsh Government policies and guidelines ? The data collected from complaints against council departments is used as big data and considered so important it is protected by legislation. The data can not be trusted...

Some local Councillors have been complaining for a while now that they feel left out of the democratic process. How are the english speaking Councillors feeling when they can not even access the webcasts?

Cyngor Gwynedd Council "It will be presented to the Council’s Cabinet meeting in October for final approval and implementation."

Recent correspondence from the Ombudsman for Wales with regard to Cyngor Gwynedd council and the Autism plan - that should have been implemented in 2019.

"Unfortunately, the Ombudsman and the Chief Executive have not yet been able to find a mutually convenient date to have the meeting I referred to in my last update to you at the end of June. This meeting will be taken forward as soon as it can practically be arranged, regardless of what I say below 

I am pleased to confirm that further progress has been made by the Council and that the finalised version of the draft plan was agreed by the project board that has met since I last wrote to you. It will be presented to the Council’s Cabinet meeting in October for final approval and implementation."

It has been a busy time for the Ombudsman during the pandemic and with the new CEO still finding his feet the delay is understandable. But has he forgotten arranging a meeting with the present Director of SS to discuss these same issues - two years ago !!?? That meeting arranged weeks in advance was cancelled by the council one hour before due.

But with no fanfare from the council and much teeth pulling, the Ombudsman appears certain that the Autism plan will be finally approved and implemented in October. We shall see...

But what of the other cases where Gwynedd council have not complied with the recommendations of Welsh Government agencies ?

This may prove difficult as the Ombudsman's office has signed off some compliance issues without checking the veracity of the departments evidence or really understanding the issues involved to the obvious benefit of Gwynedd and how many other councils ?

After a recent review the Ombudsman has now changed the process of ensuring compliance with his recommendations are met. The old system of the officer's chasing up on compliance arising from their own investigations did not work well for some reason. Will Care Inspectorate Wales be undertaking a similiar review ?

This will effect all Welsh councils but too late for many people who have brought complaints with the Ombudsman in the past and also those not realising that 'recommendations for improvement' can be downgraded with a 'variance' discussed behind closed doors months after the investigation has finished.

Cyngor Gwynedd Council - Nuance, Slippage And Non Compliance.

In 2019, the CEO of Cyngor Gwynedd, stated to Councillors that all the Ombudsman for Wales recommendations had been met 'bar a nuance'. This was not correct.

Five Ombudsman for Wales reports into Gwynedd Social Services departments over four years - with major recommendations of the Ombudsman ignored.  At this very moment a  piece of work is being prepared by the Adults department to present to the Ombudsman in the hope it will finally achieve compliance already overdue way before the pandemic. The author, Manon Trapp, was recently warned by the departing CEO that further 'slippage' will not be tolerated by the Ombudsman - so that will be an interesting document...if the council ever release it. Sshh...


This past year has seen a marked increase in complaints against the SS departments.
The present Director gives the reason for the increase as the result of a 'new' system of recording any expessions of dissatisfaction as a complaint. For several years, the departments recorded some complaints as enquiries only which would have affected the data on behaviours, performance and trends.

But, earlier this year, the Director herself downgraded a complaint to an enquiry so this makes no sense. The complaint concerned the actions of officer's that according to the senior safeguarding officer went against their very ethos - so maybe it does. Sshh...

Is Dafydd Gibbard, the new CEO, aware of the issues that the Ombudsman has uncovered over the last few years ? Of course, he is - the CEO has been with Gwynedd council since 2003 and would have heard all the stories. Nick Bennett has made quite plain his 'outrage' at the last incumbent and may already have been in contact with Mr Gibbard to ensure the new boss is aware of what is expected of him and the senior officer's. So much going on behind closed doors...

The SS department recently turned down a request for a copy of the Review of Autism Services, by Hugh Morgan, OBE, commissioned after a recommendation from an earlier Ombudsman's report - that was initially ignored. The complainants informal request was treated as a Freedom Of Information request by the Director and after the regulatory 20 days had passed the request was refused. After an Internal Review the Monitoring Officer overturned the SS decision and the report was finally released - though it is named the Derwen report for some reason. How confusing....Don't mention the A word. Sshh...

Think on that. A Monitoring Officer overturning the wishes of his own council's Director of Social Services. There has also been a recent change to the council's Constitution asked for by the Monitoring Officer that distances himself from the SS departments. What is going on...?
There appears to have been no proper scrutiny of council operations since before the pandemic and so much goes on behind the scenes unminuted and undocumented but this is not usual.

There has been a shuffling of positions within the Care Scrutiny committee too - a new Chair has been appointed. Dewi Roberts, who attempted to challenge the SS departments during his tenure has been replaced by the man he replaced, Eryl Jones-Williams - who did not. The Chair is the most important position on any committee and controls what will appear on the agenda - usually discussed and formulated at a pre-meeting with senior officers that is not open to the public and no minutes are taken.

Where is the voice of the Cabinet Members in all this ? Why the silence ?
£35,000 per annum plus expenses plus pension...comes with legal duties and responsibilities. Doesn't it?

We do not investigate individual complaints.
Still..?

And what of another Ombudsman's investigation and the findings from 2018 -

"69. - In my view, these failings not only caused Mr A a significant injustice but also impacted upon Article 8 of his Human Rights.

 However, I have decided that the finding I have made of maladministration is so clear and so serious that to consider the human rights issues further would add little value to my analysis or to the outcome.I have therefore decided to say no more about that."

The recommendations ordered by the Ombudsman in this case were also not fully complied with.

Gwynedd Council - FOI Internal Review - 50 Working Days And Counting.

In June, 2019, the Chief Executive Officer of Cyngor Gwynedd Council, Dilwyn O Williams, wrote a letter of apology for the failings found within Gwynedd Children's Social Services department. 

It was short, making no mention of the Ombudsman's findings of Gwynedd SS's interference in an 'independent' investigation, nor the behaviour by senior officers meted out to the Investigator who felt 'bullied' and 'overwhelmed' to change critical aspects of a complaint report. But he did affirm the SS department's agreement to implement the recommendations within three months that included -

The Council should (within three months) seek specialist input to develop a plan for dealing with future assessment and support requests from/for those suffering with Autism

In November, 2019, Mr Williams, declared to a Care Scrutiny Committee that all recommendations had been met, bar a nuance. Mr Williams, was then summoned to Cardiff by the Ombudsman for Wales to discuss why the recommendations had not been met.

Previous blog articles have published excerpts of emails from the Ombudsman for Wales that contradict the statements of Mr Williams and Mr Dafydd Paul to the Care Scrutiny Committee and the general public - so where are we now?

The specialist input involves a review of Autism services in Gwynedd which should have been presented to the council in March,2020. The council then told the Ombudsman that the external expert commissioned to undertake the report had failed to complete on time due to the pandemic. The Ombudsman was informed that the consultant would present the report to the council by the 30th September, 2020.

Having lost all trust in the council, a copy of this report was requested. Morwena Edwards, Director of SS, replied saying that the request had been treated as a Freedom of Information request (FOI) and the council had decided to refuse the request. So on December 3rd, 2020, an Internal Review of the FOI refusal was requested. This should by Law take 20 working days.

The 20 working days came and went with no response - then 30 days. An email was sent to the Information department asking for an update - this was ignored. A second email was sent to both the Information department and to customer care, this time asking for acknowledgment of the email - no response from either.

An email was then sent to the officer who originally dealt with the FOI request. A response was received on a Sunday explaining that the Monitoring Officer, Iwan G D Evans, was dealing with the Review and had been since December 3rd. So an email was sent to the Monitoring Officer asking for an update. This too was ignored.

As no-one had responded, the original email to Mr Evans was resent to customer care asking them to pass on the email to the Information department and the Monitoring Officer and to acknowledge receipt that the email had been received. 

A response was forthcoming this time, again from the same officer who had refused the original request. He replied that he hoped the Monitoring Officer would be in contact soon. It is now 50 working days since Mr Evans received the request for an internal review.

The Monitoring Officer has a statutory responsibility to ensure that the Council operates in a lawful manner and that it does not do anything which could amount to maladministration.
How's that going ?

The Ongoing Saga At Ysgol Dyffryn Nantlle - Cyngor Gwynedd Council.

In 2018, the BBC reported that staff at Ysgol Dyffryn Nantlle in Penygroes, had contacted their Trade Unions - NASUWT, NEU and UCAC with concerns about how the school was being run. The statement from Gwynedd council insisting good progress was being made held no water with the staff who wanted to discuss their concerns with an 'independent' party.

The joint letter from the unions repeated previous concerns teaching staff had with the school's management. Ysgol Dyffryn Nantlle was placed in special measures in 2015 which lasted until 2017 after 'robust' improvements had been made.

Sadly, issues with the school continue. A recent article published on the 7th October, 2020, by the Local Democracy reporter, Gareth Wyn-Williams, reports on an internal review commissioned by Cyngor Gwynedd council and compiled in February.

From the Daily Post article headlined - Staff morale 'extremely low' at North Wales secondary school, damning report finds -

Despite an acceptance that general pupil behaviour had improved, the report revealed that some staff remained negative about "concerning" aspects relating to a "small core."

With staff confidence in the leadership of the headteacher "needing to be restored," it reported staff openly admitting they were "afraid of some pupils" with some feeling that Ysgol Dyffryn Nantlle was "sometimes used as a dumping ground for troublesome pupils from other schools".

Among findings was that governors "did not have a firm grasp" of how the school was operating, with a danger of the body becoming "factionalised" into those who supported the headteacher and those who didn't, while also being "slow to act" on performance issues.

Many staff including the Head have been off sick for long absences which has simply added to the many problems the school has faced.

Whilst the school, the governors, the council, the GwE, tom cobley and all scramble to protect their own reputations, the well being of the children and their education for their futures appear to be last on the list of priorities.


 

Caernarfon has been an area of deprivation since forever. Millions of pounds has been thrown at the area by UK government(s), the Welsh Assembly and the European Union over the years but the people remain poor. Poor quality housing and high rents exacerbate the issues. In the 80's, heroin, poor wages and unemployment were the problem. Now it is cocaine, poor wages and unemployment..

The local children in the area suffer the consequences that such deprivation has on the mental health of their parents and the local communities yet the council pull youth clubs and support services and local businesses either close or reallocate. A vicious cycle over and over...

A 2018 FOI request revealed that 21% of the pupils at the school were recognised as having Additional Learning Needs. If the Head and staff are off sick what happens then ? How are these children being supported ?

Pupil Referral Units (PRU's) were until 2013 held in separate buildings away from school premises, now they are run on site within the schools. The PRU's in Gwynedd were highly regarded but closed due to the cuts imposed by the council. Have the closures lead to the dumping of these children back into schools who can not cope to the detriment of all ?

The figures for those recognised with ALN are even higher in other schools in Gwynedd.

One Year Of Non-Compliance - Cyngor Gwynedd Council.

It is now October - one full year of Cyngor Gwynedd council being in non compliance of the Ombudsman for Wales recommendations -

"71. The Council should (within three months) seek specialist input to develop a plan for dealing with future assessment and support requests from/for those suffering with Autism."

Nick Bennett has given the council chance after chance and even expressed to the family, his frustrations over the situation with the council - all to no avail it seems.

The council's CEO, Dilwyn Williams, appears to blame the SS departments for the 'slippage' whilst doing nothing to take control of the situation, himself. Whilst the Director of SS, who has no social work background blames the recent pandemic (that doesn't explain what happened to compliance before that time)

What to do now ? Putting in yet another complaint to the council means placing 'independent investigators' in the firing line to be bullied amd overwhelmed by senior officers and I am not prepared to do that.

Raise yet another complaint with the Ombudsman ? What is the point ? Mr Bennett is not respected by anyone in this corner of North Wales and appears powerless to hold councils to account and so it would be a waste of public resources to do so.

The complaints system in Wales is not fit for purpose and Judicial Review appears to be the only way to hold any public organisation to account. But there is no legal aid and what family can afford the £25K+ - minimum - that is required to bring such a case ? Local authorities as we know have an unlimited amount of money at their disposal from public funds. 

The Ombudsman wrote to say that the autism specialist commissioned by the council promised to present their draft report to the council by the end of September 2020.

Not quite what the the recommendation called for, but, as Mr Bennett says, it is up to him to accept any variation on recommendations - as he sees fit.

No mention is made of the Ombudsman even receiving a copy of the draft report himself and even so draft reports can be changed.......

What next ? An email from the ombudsman later on today ?

Autism Pathway ? - Cyngor Gwynedd Director Of SS Annual Report.

The Director of Cyngor Gwynedd Social Services, Morwena Edwards, has published her Annual report to be presented to the council on the 1st October.

Unlike the Welsh Government's generic report she presented last year, this report gives more detail of the performance of both the Adult and Children departments she is responsible for but like so many reports emenating from this council it doesn't seem to tell the whole story.

On page 31, under the title of Learning and Development, the Director makes mention that -

"The Department has been in contact with the Ombudsman's Office for some years now regarding one specific case....
The Department has
received many recommendations from the Ombudsman, and one remains as outstanding; however, slippage has been seen in the work as a result of the Covid-19 crisis."

The Covid-19 crisis is only the latest 'reason' for 'slippage', so somewhat misleading....

 (There have been 5 Ombudsman investigation reports into both the Adult and Children departments - in 4 years.)
 
In June, 2019, the Chief Executive Officer, Dilwyn O Williams, sent a letter to the family apologising for all the failings upheld by the Ombudsman's investigation and informed that the Children's department had agreed to implement the recomendations by September, 2019.
 
 The Ombudsman's recommendation regarding autism is as follows -

"71. The Council should (within three months) seek specialist input to develop a plan for dealing with future assessment and support requests from/for those suffering with Autism."
 
The Council's action to meet this recommendation was to provide the Ombudsman's investigator with a copy of the "Integrated Autism Service (IAS) North Wales Update- February 2018" and a copy of the "supporting guidance" document.

No specialist input sought.  Just yet another attempt to avoid creating any 'pathway' for autistic individuals seeking social services care assessments or support. 
 
This 'evidence' was obviously not sufficient to meet the Ombudsman's recommendation and in October 2019, an officer of the Ombudsman for Wales contacted the council for an explanation of why the recommendations had not been completed as agreed and a phone call was arranged with the director Mrs Edwards to discuss compliance matters. Even though this call was arranged two weeks previous, - the council cancelled the call an hour before it was due.
 
The IAS do not carry out 'care assessments', that is the domain of health and social services, although autism advice can be sought from the IAS during the process.
 
As robust evidence of compliance was yet to be provided to the Ombudsman, in November 2019, the CEO was summoned to Cardiff to explain the 'slippage' to the Ombudsman, himself, we were also informed that the Ombudsman had other matters to discuss with the CEO..... 

(I wonder how much this cost Gwynedd taxpayers claimed as expenses but at least there was an opportunity for the CEO to do some Christmas shopping in the capital.)
 
Earlier this year, the CEO admitted that the Ombudsman for Wales is 'outraged' with Gwynedd council.
Not that outraged, as Nick Bennett could have published a 'Special Report' as he did with the Wrexham council when they failed to comply with recommendations agreed after an investigation.
 
All this was many months before the #Covid19 crisis and for the Director of Gwynedd SS to now use the pandemic as an excuse to cover for her departments failings is disingenuous.
 
When the pandemic took hold, the Ombudsman for Wales did indeed grant Cyngor Gwynedd extra time to comply with the recommendations for improvement. On the 11th June 2020, the Ombudsman wrote to the family - 


Fair enough - the pandemic has affected everything, though the Gwynedd council staff outing where one officer contracted the virus on a night out forcing an entire council group to self isolate for two weeks was not appreciated by anyone.
 
The Ombudsman wrote again to the family on the 24th August 2020 - 
 
        
So why is none of this mentioned in the Director's Annual report ? Sshh....Is it a secret ?
